Cependant, si un besoin urgent le n\u00e9cessite, l\u2019employeur peut faire appel \u00e0 lui pour lui demander d\u2019accomplir un travail.<\/p>\n<\/div>\n<div class=\"ct_texte_paragraphe\">\n<p>Jusqu\u2019\u00e0 la loi du 19\u00a0janvier 2000, il n\u2019\u00e9tait pratiquement pas question d\u2019astreinte dans le code du travail.<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div class=\"ct_texte_paragraphe\">\n<p>Seul l\u2019article L. 212-2 de ce code, permettait \u00e0 des d\u00e9crets en Conseil des ministres de fixer les conditions de recours aux astreintes pour des branches ou professions particuli\u00e8res, cette possibilit\u00e9 n\u2019ayant pas \u00e9t\u00e9 utilis\u00e9e. Il a \u00e9t\u00e9 modifi\u00e9 \u00e0 cet effet par la loi quinquennale de 1993.<\/p>\n<\/div>\n<div class=\"ct_texte_paragraphe\">\n<p>La loi du 19\u00a0janvier 2000 a repris un certain nombre d\u2019\u00e9l\u00e9ments qui avaient \u00e9t\u00e9 d\u00e9gag\u00e9s par la jurisprudence.<\/p>\n<div class=\"ct_texte_paragraphe\">\n<p>La p\u00e9riode d\u2019astreinte est d\u00e9finie comme une p\u00e9riode pendant laquelle le salari\u00e9, sans \u00eatre sur son lieu de travail et sans \u00eatre \u00e0 la disposition permanente et imm\u00e9diate de l\u2019employeur, doit \u00eatre en mesure d\u2019intervenir pour effectuer un travail au service de l\u2019entreprise, la dur\u00e9e de cette intervention \u00e9tant consid\u00e9r\u00e9e comme du travail effectif.<\/p>\n<\/div>\n<div class=\"ct_texte_paragraphe\">\n<p>Enfin, la loi Travail a modifi\u00e9 la d\u00e9finition l\u00e9gale pour supprimer la r\u00e9f\u00e9rence au fait que l\u2019int\u00e9ress\u00e9 soit bas\u00e9 \u00e0 son domicile ou \u00e0 proximit\u00e9. Ceci car\u00a0l\u2019astreinte n\u2019excluant pas que le salari\u00e9 se d\u00e9place d\u00e8s lors qu\u2019il peut intervenir s\u2019il est appel\u00e9.
