En fin de bail pour le renouvellement, il existe trois situations pouvant \u00eatre envisag\u00e9es si :<\/p>\n<\/div>\n<div class=\"ct_enum_paragraphe\">\n<p>-le bailleur prend l\u2019initiative de notifier un cong\u00e9 (cong\u00e9 offrant ou refusant le renouvellement) ;<\/p>\n<\/div>\n<div class=\"ct_enum_paragraphe\">\n<p>-le locataire prend l\u2019initiative et demande le renouvellement du bail ;<\/p>\n<\/div>\n<div class=\"ct_enum_paragraphe\">\n<p>-les deux parties gardent le silence.<\/p>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div class=\"ct_texte_paragraphe\">\n<p>De plus, si le bailleur veut \u00e9viter la reconduction implicite du bail ainsi que sa poursuite pour une dur\u00e9e ind\u00e9termin\u00e9e, il doit notifier au preneur un cong\u00e9. En effet, \u00e0 d\u00e9faut de cong\u00e9 valable (ou de demande de renouvellement par le locataire), un bail soumis au statut des baux commerciaux se poursuit automatiquement au-del\u00e0 de la date contractuellement fix\u00e9e pour son expiration ; il n\u2019y a pas formation d\u2019un nouveau contrat. Cependant, en l\u2019absence de cong\u00e9, le bail se poursuit aux m\u00eames conditions et il n\u2019y a pas renouvellement automatique.<\/p>\n<\/div>\n<div class=\"ct_texte_paragraphe\">\n<p>En pratique, le propri\u00e9taire, m\u00eame s\u2019il entend renouveler le bail, donne cong\u00e9 \u00e0 son locataire ; cette formalit\u00e9 lui permet notamment de pr\u00e9voir un nouveau loyer, car, en cas de tacite reconduction, seule la r\u00e9vision triennale est admise.<\/p>\n<\/div>\n<div class=\"ct_texte_paragraphe\">\n<p>Le cong\u00e9 donn\u00e9 par le bailleur peut se trouver en concurrence avec une demande de renouvellement par le preneur ; dans de nombreux cas, ce cong\u00e9 ne paralyse pas l\u2019action du locataire.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Un bail commercial est un contrat sign\u00e9 entre le bailleur, en g\u00e9n\u00e9ral le propri\u00e9taire du local, et le locataire.
